Thursday, October 14, 2010
Dear Corbin T. Jones and all FEC.GOV Commissioners on 10/14/2010:
I am responding to your September 09, 2010 letter (2) in which you
stated the following:
==========
"REFERENCE: AMENDED STATEMENT OF ORGANIZATION, RECEIVED 08/22/2010
Dear Treasurer:
Response Due Date
10/14/2010
IDENTIFICATION NUMBER: C00278333
This letter is prompted by the Commission's preliminary review of the
report(s) referenced above. This notice requests information essential
to full public disclosure of your federal election campaign finances.
Failure to adequately respond by the response date noted above could
result in an audit or enforcement action.
Additional information is needed for the following 1 items:
1. Your committee has filed an amended Statement of Organization to
reflect a change(s) in your registration information. Please be advised
that under 11 CFR §104.18(f), if a political committee files an
amendment to a report that was filed electronically, the political
committee shall submit a complete version of the report as amended,
rather than just those portions of the report that are being amended.
Further, 11 CFR §104.18(c) defines report as any statement, designation
or report required by the Act to be filed with the Commission. Please
provide a complete amended Statement of Organization to disclose any
omitted information.
Please note, you will not receive an additional notice from the
Commission on this matter. Adequate responses must be received by the
Commission on or before the due date noted above to be taken into
consideration in determining whether audit action will be initiated.
Failure to comply with the provisions of the Act may also result in an
enforcement action against the committee. Any response submitted by
your committee will be placed on the public record and will be
considered by the Commission prior to taking enforcement action.
Requests for extensions of time in which to respond will
not be considered.
Electronic filers must file amendments (to include statements,
designations and reports) in an electronic format and must submit an
amended report in its entirety, rather than just those portions of the
report that are being amended. If you should have any questions
regarding this matter or wish to verify the adequacy of your response,
please contact me on our toll free number (800) 424-9530 (at the prompt
press 5 to reach the Reports Analysis Division) or my local number
(202) 694-1177.

==========
I am responding to your September 9, 2010 letter.
It is not my intent to be rude or unkind in my remarks.
It is however my intent to once again bring to the attention of the
Federal Election Commission (FEC.GOV), frustrations that I have in the
hopes that those frustrations will be eased because of steps taken by
FEC.GOV to become the govenmental body that it claims that it is
through documents and statements on their website.
If I understand correctly what you said in your letter dated September
9, 2010 then there's absolutely no reason for you to include any
ability whatsoever for your software FECFILE to be able to do anything
by any user of your software FECFILE to be able to use the function to
be able to file a FEC FORM 1, STATEMENT OF ORGANIZATION form.
The only thing I have been able to do with your software FECFILE is
what I did on August 22, 2010 and on July 18, 2010 put text within the
memo area. I do not know whether you, Corbin Jones, or the
(FEC.GOV) commissioners were aware of this flaw with your software
FECFILE?
Again, the only change I could make was within your software "FECFILE"
was to be able to write within the memo area of the software as far as
FEC FORM 1, STATEMENT OF ORGANIZATION form.
Even though your above referenced letter did not say anything about the
FEC FORM 1, STATEMENT OF ORGANIZATION form that I filed on July 18,
2010 in which I stated in the memo area:
"Our new bank is: First Banks, Inc. - 27067 McBean Parkway, Valencia,
CA, 91355-5145"
Then on August 22, 2010 I filed the FEC FORM 1, STATEMENT OF
ORGANIZATION form in which I stated in the memo area:
"Our name on your website address of
http://www.fec.gov/pubrec/pacronyms/Pacronyms.pdf says: Citizens for a
Better America (CFABA.Org) it should be Citizens For A Better America
(R) (CFABA.ORG)"
Again, it is not my intent to be rude or unkind in my
remarks. Frankly, I am very offended by your above referenced
letter. You stated "Any response submitted by your committee
will be placed on the public record and will be considered by the
Commission prior to taking enforcement action." I requested and
demanded that (FEC.GOV) place my letters on the same Internet web page
that has your letters "REQUEST FOR ADDITIONAL INFORMATION" and yet
(FEC.GOV) has not posted a "RESPONSE TO REQUEST FOR ADDITIONAL
INFORMATION".
While I really appreciated commissioner Michael E. Toner posting my
January 16, 2007 (4) letter under the title "MISCELLANEOUS REPORT TO
FEC" on 01/30/2007. No other commissioner did what
commissioner Michael E. Toner, had done.
As far as I am concerned the statement "will be placed on the public
record" is not accurate unless responses like these from political
committees are placed on the same page as your letters "REQUEST FOR
ADDITIONAL INFORMATION".
However, I made such passionate Pleas during my January 17, 2006 (3)
and my January 16, 2007 (4) letters. It appears that
(FEC.GOV) completely and wholeheartedly rejected such Pleas.
It appears that (FEC.GOV) feels there are no repercussions for bad
behavior. I will now stop my rebuke of (FEC.GOV).
You stated:
"Please be advised that under 11 CFR §104.18(f), if a political
committee files an amendment to a report that was filed electronically,
the political committee shall submit a complete version of the report
as amended, rather than just those portions of the report that are
being amended. Further, 11 CFR §104.18(c) defines report as any
statement, designation or report required by the Act to be filed with
the Commission. Please provide a complete amended Statement of
Organization to disclose any
omitted information."
If I understood you correctly in the above referenced statement you
would like us to file a complete FEC FORM 1, STATEMENT OF ORGANIZATION
form (5).
Since FECFILE in unable to accomplish that objective I have created a
hybrid complete FEC FORM 1, STATEMENT OF ORGANIZATION form (5), which
has all the information that I believe you are looking for.
Sincerely,
Robert Colaco
